Terms & Conditions

Effective September 16, 2026

These Terms & Conditions apply to services performed by RBI Land Services, operated by RBI Holdings, LLC (“RBI Land Services,” “RBI,” “Contractor,” “we,” or “us”). By approving an estimate, signing a proposal or service agreement, paying a deposit, or authorizing RBI Land Services to begin work, the customer (“Customer”) agrees to these Terms & Conditions.

1. Estimates and Scope of Work

RBI Land Services will perform the work described in the Customer’s approved estimate, proposal, or service agreement. Work not specifically listed is not included. Additional work or materially changed conditions may result in additional charges and will be communicated for approval when reasonably possible.

2. Payment Terms

A 50% deposit is required to schedule the project and secure the anticipated start date. The remaining 50% is due upon completion of the agreed scope of work. Larger or multi-phase projects may use a different written progress-payment schedule. Approved additions are added to the Customer’s balance.

3. Scheduling and Project Dates

Project dates are estimates and may change because of weather, ground conditions, equipment availability, mechanical issues, fire danger, permitting, utility-location requirements, site conditions, or other circumstances reasonably outside RBI Land Services’ control.

4. Cancellation and Rescheduling

If RBI Land Services has already incurred project-specific expenses, mobilization costs, special-order expenses, permit expenses, or other nonrecoverable costs, those amounts may be deducted from any refundable portion of the Customer’s deposit to the extent permitted by applicable law. Project-specific written terms control if different.

5. Property Access

The Customer authorizes RBI Land Services and its employees, subcontractors, vehicles, trailers, and equipment to enter the property as reasonably necessary. The Customer is responsible for adequate access and for disclosing gates, bridges, culverts, driveways, septic systems, soft ground, weight restrictions, livestock, pets, and other relevant conditions.

6. Property Lines and Work Areas

The Customer is responsible for accurately identifying property boundaries and areas authorized for work. RBI Land Services may rely on boundaries identified by the Customer unless surveying is specifically included. RBI Land Services does not provide land-surveying services.

7. Utilities and Underground Improvements

The Customer must disclose known private or customer-owned underground or concealed improvements, including septic, irrigation, private electrical or water lines, propane lines, drainage, wells, invisible fencing, and similar installations. RBI Land Services will comply with applicable utility-location requirements. To the extent permitted by law, RBI Land Services is not responsible for undisclosed or improperly identified private utilities or concealed improvements.

8. Site and Ground Conditions

Heavy equipment may cause reasonable and unavoidable track marks, ruts, soil compaction, vegetation disturbance, mud, dust, displaced rock, or similar effects. Restoration is not included unless specifically stated in the approved estimate.

9. Hidden or Unexpected Conditions

Pricing is based on reasonably observable conditions and information provided by the Customer. Buried concrete, wire, fencing, debris, rock, abandoned structures, underground improvements, large root systems, unstable soil, excessive mud, hazardous materials, or other concealed obstacles may require a change in scope, time, equipment, or price.

10. Trees, Vegetation and Forestry Mulching

The Customer is responsible for identifying items to remain protected. Forestry mulching results vary with vegetation, density, terrain, moisture, and equipment conditions. Unless specifically included, mulching does not include stump excavation, complete root removal, finish grading, seeding, erosion-control installation, or removal of all organic material.

11. Debris, Hauling and Disposal

Mulching, piling, hauling, disposal, burning, or removal is included only when specifically stated in the estimate. Additional hauling or disposal may result in additional charges.

12. Weather and Unsafe Conditions

RBI Land Services may delay, suspend, or reschedule work when weather, saturated soil, excessive heat, high winds, fire danger, poor visibility, equipment conditions, or other circumstances make continued operation unsafe or likely to cause unreasonable property damage.

13. Customer Changes and Change Orders

Changes should be requested before additional work begins. Approval may be documented by signed change order, electronic approval, text, email, or another agreed written method. Substantial additions may require an additional deposit.

14. Permits and Approvals

Unless specifically included, the Customer is responsible for property-owner, HOA, easement, environmental, or other private approvals. Responsibility for governmental permits will be identified when known to be required.

15. Customer Representations

The Customer represents that the Customer owns the property or has authority to authorize the work and will disclose known restrictions affecting it.

16. Damage and Limitation of Responsibility

RBI Land Services will use reasonable care. To the extent permitted by law, RBI Land Services is not responsible for damage caused by inaccurate Customer information, incorrectly identified boundaries, undisclosed underground improvements, concealed hazards, pre-existing conditions, or ordinary and reasonably foreseeable ground disturbance from heavy equipment. Nothing here waives liability that cannot legally be waived.

17. Photographs and Project Documentation

RBI Land Services may photograph or record the work area for estimating, project documentation, safety, insurance, and quality control. Permission will be obtained before using identifiable Customer information or sensitive property details for promotional purposes.

18. Completion of Work

A project is considered complete when RBI Land Services has substantially completed the agreed scope, subject to agreed punch-list items. Customers should promptly report concerns.

19. Governing Law

These Terms & Conditions are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

20. Entire Agreement

The approved estimate, proposal, service agreement, approved change orders, and these Terms together constitute the project agreement. A specific written project provision controls if it conflicts with these general Terms.

Customer acknowledgment: By signing or electronically approving an RBI Land Services estimate or proposal, paying the required deposit, or otherwise authorizing work, the Customer acknowledges that the Customer has reviewed and agrees to these Terms & Conditions.
